1. Scope and Acceptance

1. These General Terms and Conditions (hereinafter “Terms”) govern all orders placed with Sessia GmbH (hereinafter “Sessia”, “Company”, “we”, “us”) through our website, by email, or by telephone.

1.2. By visiting our website, placing an order, or accepting delivery of products, you (hereinafter “Customer”, “you”) agree to be bound by these Terms

1.3. A binding contract is formed between you and Sessia upon our acceptance of your order, confirmed by email.

1.4. Any deviating, conflicting, or supplementary terms and conditions of the Customer shall only become part of the contract if and to the extent that Sessia has expressly agreed to them in writing.

2. How to Place an Order

2.1. You may place an order in the following ways:

  • By shopping on our website and completing the checkout process
  • By sending a detailed order by email to [email protected]
  • By phone Mon–Thu 10:00–18:00, Fri–Sat 10:00–17:00 CET at +43 676 4702852

2.2. After receiving your order, we will send you an order confirmation email. This confirmation constitutes our acceptance of your order and the formation of a binding contract.

2.3. Once your order is shipped, you will receive a shipping confirmation email with tracking information (either directly from us or from our logistics partners).

2.4. We reserve the right to decline or cancel any order at our discretion, including but not limited to cases where:

  • Products are unavailable or out of stock
  • Pricing or product information contains obvious errors (see Section 4)
  • We are unable to verify payment or billing information
  • Delivery restrictions apply to your location

2.5. If we cannot fulfill your order due to unavailability from our suppliers, we reserve the right to withdraw from the contract. You will be informed immediately by email, and any payment made will be refunded in full within 14 days.

3. Prices and Payment

3.1. Prices

3.1.1. All prices displayed on our website are in Euro (EUR) and include applicable Austrian VAT unless otherwise stated.

3.1.2. Shipping costs are not included in the product price and will be calculated and displayed separately during checkout

3.1.3. For deliveries outside the European Union, the displayed prices do not include customs duties, import taxes, or other charges that may be levied by your country. You are responsible for all such charges (see Section 5.4).

3.1.4. We reserve the right to change prices at any time. However, the price applicable to your order is the price displayed at the time you place your order and confirmed in your order confirmation email.

3.2. Payment Methods

We accept the following payment methods (availability may vary depending on delivery country):

  • 1. PayPal: You will be redirected to PayPal’s website to complete payment. After payment, you will be redirected back to our site to view your order confirmation
  • 2. Credit Card (via Select 2 Pay): We accept major credit cards. Credit card payments are processed via our external payment service provider Select 2 Pay. Your card data is transmitted directly to Select 2 Pay and is not stored on our servers. Your card will be charged when we ship your order.
  • 3. Bank Transfer (Prepayment): You transfer the total amount to our bank account in advance. Bank details will be provided in your order confirmation. We will ship your order after receiving payment and send you a shipping confirmation

3.2.1. Payment processing is conducted through secure third-party payment processors (including Select 2 Pay and PayPal). We do not store your complete credit card information on our servers

3.2.2. Our SSL (Secure Socket Layer) software encrypts all personal and payment information during transmission to protect against unauthorized access

3.3. Payment Terms

3.3.1. Payment is due immediately upon order placement.

3.3.2. For prepayment orders, we will hold your order for 7 days pending receipt of payment. If payment is not received within this period, the order will be automatically cancelled.

4. Product Information and Errors

4.1. We endeavor to ensure that all product descriptions, images, specifications, and prices on our website are accurate. However, errors may occur

4.2. Product images are for illustrative purposes only. Actual products may vary slightly in appearance, color, or packaging.

4.3. If a manifest error occurs (such as an obviously incorrect price, e.g., EUR 0.01 instead of EUR 100), we reserve the right to cancel the order even after confirmation and to refund any payment received. We will notify you immediately of such cancellation.

4.4. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice (including after you have submitted your order).

4.5. The accuracy and availability of stock displayed on our website are not guaranteed in real-time. In case of unavailability, we will contact you and offer alternatives or a full refund

5. Delivery and Shipping

5.1. Delivery Terms

5.1.1. Sessia organizes delivery of products ordered by the Customer in accordance with the quantities, delivery dates, and shipping instructions specified in the order.

5.1.2. All shipments are sent via courier services designated by Sessia.

5.1.3. If the recipient is not available at the time of delivery, the courier will attempt to contact you to arrange redelivery

5.1.4. Each delivery is accompanied by an invoice containing payment details, product names, and any other documents required by applicable law.

5.2. Delivery Times

Estimated delivery times are as follows:

  • EU countries: up to 2 weeks from order confirmation
  • Other European countries: up to 3 weeks from order confirmation
  • Worldwide destinations: up to 10 weeks from order confirmation

5.2.1. These are estimates only and not guaranteed delivery dates. Actual delivery times may vary depending on destination, customs clearance, and other factors beyond our control

5.2.2. Most products are processed and ready for shipment within 48 hours of order confirmation, unless otherwise communicated.

5.3. Shipping Costs

5.3.1. Shipping costs are calculated based on destination and selected shipping method (standard or express, where available) and are displayed during checkout before you complete your order.

5.3.2. Shipping costs are non-refundable except in cases where we have made an error or delivered defective products (see Section 9).

5.4. Delivery Outside the EU

5.4.1. All our products are shipped from within the European Union.

5.4.2. For deliveries outside the EU, customs duties, import taxes, VAT, and other charges may apply upon import into your country.

5.4.3. You are solely responsible for all such customs and import charges. Please consult your local customs authorities regarding charges and import regulations before ordering.

5.4.4. Sessia is not responsible for any customs or import charges, delays caused by customs clearance, or refusal of entry by customs authorities.

5.5. Failed Delivery and Delays

5.5.1. If a package is not delivered within the estimated timeframe specified in Section 5.2, you may contact us to request either:

  • A credit note for future purchases, or
  • An agreed extension of delivery time

5.5.2. The Company shall not be liable for delays or non-delivery caused by circumstances beyond our reaonable control, including but not limited to:

  • Force majeure events (see Section 17)
  • Political barriers, trade restrictions, or disputes between countries
  • Customs delays or rejections
  • Incorrect or incomplete delivery address provided by Customer
  • Failure of Customer to accept delivery
  • Strikes, natural disasters, pandemics, or governmental actions

5.6. Risk of Loss

5.6.1. Risk of loss and damage passes to you upon delivery to the carrier.

5.6.2. If you receive a damaged package, you should immediately file a complaint with the delivery person and refuse to accept the package if possible. Also contact us immediately, and we will arrange a replacement shipment free of charge (see Section 9).

6. Retention of Title

6.1. All goods delivered to you remain the property of Sessia until full payment has been received.

6.2. Until full payment, you may not pledge, assign, or otherwise encumber the goods.

7. Right of Withdrawal (Widerrufsrecht) for Consumers

7.1. Withdrawal Right

7.1.1. If you are a consumer (a natural person acting for purposes outside your trade, business, or profession), you have the right to withdraw from the contract within 14 days without giving reasons, in accordance with EU consumer protection law.

7.1.2. The withdrawal period is 14 days from the date on which you (or a third party designated by you, other than the carrier) took physical possession of the goods.

7.1.3. To exercise your right of withdrawal, you must inform us of your decision to withdraw by means of a clear statement (e.g., by email to [email protected] or by letter to our address).

7.2. Withdrawal Procedure

7.2.1. Important: Returns without prior notice will not be accepted.

7.2.2. To initiate a return, you must contact us by email or telephone. We will provide you with instructions on how to return the products

7.2.3. You must send back the goods within 14 days from the day on which you communicated your withdrawal to us.

7.2.4. Products must be returned in their original condition, unused, undamaged, and in original packaging where possible.

7.3. Cost of Return

7.3.1. For standard withdrawals (change of mind), you bear the direct cost of returning the goods unless we have agreed otherwise.

7.3.2. In cases where the products are defective, incorrect, or we made an error, we will cover the cost and risk of the return (see Section 9).

7.4. Refund

7.4.1. If you effectively withdraw from the contract, we will refund all payments received from you, including delivery charges (except for any supplementary costs arising if you chose a type of delivery other than the standard delivery offered by us), without undue delay and in any event not later than 14 days from the day we receive the returned goods.

7.4.2. We will make the refund using the same payment method you used for the original transaction, unless expressly agreed otherwise. You will not incur any fees as a result of the refund.

7.4.3. We may withhold the refund until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is earliest.

7.5. Exclusions

The right of withdrawal does not apply to contracts concerning:

  • Goods that are sealed and were unsealed after delivery and are not suitable for return due to health protection or hygiene reasons
  • Goods that are, by their nature, inseparably mixed with other items after delivery
  • Perishable goods or goods with an expiry date that has passed

8. Exchanges and Voluntary Returns

8.1. If you are not entirely satisfied with your purchase for reasons not related to defects or errors on our part, you may return items within 14 days of delivery for a full refund of the product price (subject to the procedures in Section 7).

8.2. You must contact us before returning any items. Returns sent without prior authorization will not be accepted.

8.3. Shipping costs are non-refundable for voluntary returns unless the return is due to our error or defective products.

9. Defective or Incorrect Products

9.1. Our Responsibility

9.1.1. If we made an error and you did not receive the items you ordered, or if the items received are damaged or defective, we will take full responsibility.

9.1.2. Please contact us immediately by email or telephone if you receive incorrect or defective products.

9.2. Return Procedure

9.2.1. Fill out the return form (if provided) and return the items to us in their original packaging where possible.

9.2.2. After receiving the exchange or replacement shipment, you are required to return the original shipment within 30 days.

9.2.3. In all cases of returns due to our error or defective products, we will cover the cost and risk of the return shipment.

9.3. Remedy

We will, at our option, either:

  • Replace the defective or incorrect items free of charge, or
  • Issue a full refund including original shipping costs

9.4. Shipping Damage

9.4.1. If you receive a package that is visibly damaged, you should make a complaint immediately with the delivery person and, if possible, refuse to accept the package

9.4.2. Contact us as soon as possible, and we will send you a replacement for the damaged itemsfree of charge

10. Warranty and Statutory Rights

10.1. Nothing in these Terms affects your statutory rights under applicable consumer protection law, including rights under the Austrian Consumer Protection Act (Konsumentenschutzgesetz) or other mandatory provisions of EU law.

10.2. Statutory warranty claims for defects (Gewährleistung) apply in accordance with Austrian law.

10.3. The limitation periods for warranty claims are governed by applicable statutory provisions.

11. Limitation of Liability

11.1. Product Liability Disclaimer

11.1.1. All products presented on this website are food, dietary supplements, or cosmetics and are not medicines or medical devices.

11.1.2. All content on this website is intended solely to inform about the nutritional and physiological processes of dietary supplements. The information provided is for informational purposes only and is not intended as a substitute for advice from your physician or other healthcare professional.

12. Data Protection

12.1. We process your personal data in accordance with applicable data protection laws, including the GDPR and the Austrian Data Protection Act (DSG).

12.2. Personal data collected in connection with your order (such as name, address, email, payment and order details) is used for order processing, customer service, and compliance with legal obligations.

12.3. Payment data is processed via external payment service providers such as Select 2 Pay and PayPal. For details, please refer to our Privacy Policy.

12.4. For detailed information about how we handle your personal data, your rights under GDPR, and how to exercise those rights, please refer to our Privacy Policy (available on our website).

13. Intellectual Property Rights

13.1. All content on this website, including but not limited to text, graphics, logos, images, photographs, audio clips, video clips, data compilations, and software, is the property of Sessia or its licensors and is protected by Austrian and international copyright, trademark, and other intellectual property laws

13.2. You may not copy, reproduce, republish, upload, post, transmit, distribute, or modify any content from this website without prior written consent from Sessia

13.3. You may print or download extracts from this website solely for your personal, non-commercial use for the purpose of placing an order or reviewing product information.

13.4. Any unauthorized use of content from this website may violate copyright, trademark, and other laws and may result in legal action

14. User Obligations and Prohibited Conduct

14.1. You agree to use our website and services only for lawful purposes and in accordance with these Terms.

14.2. You agree not to:

  • Use our website in any way that violates any applicable national or international law or regulation
  • Provide false, inaccurate, or misleading information when placing an order
  • Engage in any fraudulent activity or impersonate any person or entity
  • Attempt to gain unauthorized access to our website, servers, or databases
  • Interfere with or disrupt the operation of our website or servers
  • Use automated systems or software to extract data from our website (scraping) without our prior written consent
  • Resell products purchased from us for commercial purposes without authorization

15.2. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites.

15.3. You acknowledge and agree that Sessia shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of any content, goods, or services available on or through any third-party websites

15.4. We strongly advise you to read the terms and conditions and privacy policies of any third-party websites you visit.

16. Amendments to Terms

16.1. We reserve the right to modify or replace these Terms at any time at our sole discretion.

16.2. We will provide notice of material changes by posting the updated Terms on our website with a new “Effective Date.”

16.3. Your continued use of our website or services after any changes become effective constitutes your acceptance of the revised Terms.

16.4. It is your responsibility to review these Terms periodically for changes.

17. Force Majeure

17.1. Sessia shall not be liable for any failure or delay in performing its obligations under these Terms if such failure or delay is due to circumstances beyond our reasonable control.

17.2. Force majeure events include, but are not limited to:

  • Acts of God (earthquakes, floods, storms, etc.)
  • War, terrorism, civil unrest, or armed conflict
  • Pandemics, epidemics, or other public health emergencies
  • Strikes, labor disputes, or lockouts (other than those involving our own employees)
  • Fire, explosion, or accident
  • Governmental actions, laws, regulations, or orders
  • Failure of suppliers, carriers, or other third parties
  • Interruption of transportation or telecommunication services

17.3. If a force majeure event continues for more than 60 days, either party may terminate the affected contract by written notice, and any payments made for undelivered goods shall be refunded

18. Governing Law and Jurisdiction

18.1. Governing Law

18.1.1. These Terms and any contracts formed under them shall be governed by and construed in accordance with the laws of Austria, excluding its conflict of law provisions.

18.1.2. The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is expressly excluded.

18.1.3. If you are a consumer within the European Union, you also enjoy protection under the mandatory consumer protection provisions of the law of the country in which you are resident.

18.2. Jurisdiction

18.2.1. If you are a business customer (entrepreneur), the exclusive place of jurisdiction for all disputes arising from or in connection with these Terms shall be Vienna, Austria.
